Welcome to Soul & Spur Collective (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the website located at www.soulandspurcollective.com (the “Site”), and your purchase of any goods or services from us.
By using the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not access or use the Site.
1. Eligibility & Conduct
To use this Site and make a purchase, you must:

Not interfere with or disrupt the functionality or security of the Site.
You are responsible for ensuring that all personal and payment information provided is accurate and up to date.
2. Product Fulfillment & Ownership
All products sold through Soul & Spur Collective are exclusively designed, quality-controlled, and fulfilled by our company. While we may use professional printing partners to help bring your order to life, your products come directly from Soul & Spur Collective.
We do not resell third-party branded goods. Every product is custom-made for you once your order is placed.
3. Product Accuracy
We make every effort to represent products accurately through images, descriptions, and sizing charts. However, due to the nature of custom-made items, slight variations may occur in color, print placement, or scale. These are normal and do not constitute defects.
4. Order Processing, Shipping & Delivery

Orders are made to order and typically process within 2–5 business days.

Shipping estimates are provided at checkout and vary by region (usually 3–10 business days U.S.).

Shipping times may be affected by high demand, holidays, weather, or carrier delays beyond our control.
We are not liable for delivery delays caused by postal carriers or incorrect shipping addresses provided by the customer.
5. Payment, Taxes & Order Cancellation
Prices are listed in USD and may be adjusted at any time without prior notice.
We accept major credit cards, debit cards, and PayPal through secure Shopify checkout. You are responsible for all applicable local taxes, duties, or import fees.
We reserve the right to cancel any order suspected of fraud or violation of these Terms. If we do cancel, you’ll be notified and refunded promptly.
6. 100% Satisfaction Guarantee
We want you to love your order! If your item arrives damaged, misprinted, or you’re unhappy with the quality:

Include your order number and clear photos if applicable

We will offer a replacement, refund, or store credit, at our discretion
This guarantee covers product quality and print issues, not changes of mind or wrong size selections.
7. Return Policy & Restocking Fee
We accept returns on a limited basis due to the made-to-order nature of our items.
Returns must be pre-approved and meet the following criteria:

Request submitted within 7 days of delivery

Item must be unworn, unused, and in original condition

Approved returns are subject to a 20% restocking fee, which will be deducted from the refund amount

Return shipping is the responsibility of the customer
Once received and inspected, refunds (minus the restocking fee) will be processed back to your original payment method within 5–10 business days.
We do not accept returns for:

Size or fit issues where accurate size guides were provided

Customer errors in ordering (e.g., incorrect color, address, etc.)

Final sale or promotional items
8. Intellectual Property
All site content—including product designs, logos, images, graphics, and text—is the property of Soul & Spur Collective and protected by U.S. and international copyright laws.
You may not reproduce, resell, or distribute any part of our content without express written permission.
9. Limitation of Liability
To the fullest extent permitted by law, Soul & Spur Collective shall not be liable for:

Any indirect, incidental, punitive, or consequential damages

Loss of profits, data, or goodwill

Any issues caused by third-party delivery services or website hosting platforms
Our total liability for any claim will not exceed the amount paid for the product in question.
10. Disclaimer of Warranties
Products and services are provided “as is” and “as available.”
We do not guarantee:

That the Site will be uninterrupted or error-free

That products will meet personal expectations beyond what is stated
11. Third-Party Tools and Integrations
We may offer tools or services (e.g., payment processors, analytics, shipping carriers) provided by third parties. We are not responsible for the terms, reliability, or actions of those third parties. You use them at your own risk.
12. Dispute Resolution
If a dispute arises, please contact us directly at stephanie@soulandspurcollective.com so we can resolve it quickly and fairly.
If unresolved, you agree that any legal action shall be submitted to binding arbitration in the State of Massachusetts, and you waive the right to a jury trial or class action.
13. Termination
We reserve the right to refuse service, suspend access, or cancel orders if we believe you have violated these Terms or engaged in inappropriate behavior toward our team.
14. Governing Law
These Terms shall be governed by the laws of the United States and the State of Massachusetts without regard to its conflict of law principles.
